Temporary Residence for Employment

A foreigner can work in Montenegro on the basis of a temporary residence and work permit or work registration certificate, unless otherwise provided by the law. A foreigner can perform in Montenegro only those activities that the temporary residence and work permit or work registration certificate was issued for, and only for the employer who employs him/her.

Requirements

The temporary residence and work permit for the employment and seasonal employment shall be issued to a foreigner who meets the following requirements:
  • has means of subsistence;
  • has provided accommodation;
  • has health insurance;
  • has submitted evidence justifying of the application for a permit issuance.
  • has a valid foreign travel document or identity card issued by the competent authority of another state;
  • was not imposed a prohibition on entry and residence in Montenegro;
  • in Montenegro has not been legally sentenced to an imprisonment of more than six months for a criminal offense prosecuted ex officio, or the legal consequences of a conviction ceased;
  • in the country of origin has not been legally sentenced to an imprisonment of more than six months for a criminal offense prosecuted ex officio, or the legal consequences of a conviction ceased;
  • there are no restrictions due to the reasons of national security, public order or public health;
  • she has submitted evidence of justifying the application for a permit issuance

A proof of the justification of an application:

Apart from the requirements above, the applicant submits the following as a proof of the justification of an application: 1) a written offer of the employer for hiring a foreigner on a particular work position; 2) a proof of the acquired level of education and qualification; 3) a proof of good health

Temporary residence permit for property owners

Starting from November 3, 2015  now all foreign owners of property in Montenegro could apply for temporary residence in Montenegro. In order to apply for temporary residence for 1 year, the property owner should fill in, sign and submit an application for temporary residence permit to the Ministry of Foreign Affairs. All applications should be submitted in person, while the application fee of EUR 45 per person shall be paid. The time for processing the residency application is 40 days.

The following documents should be submitted:

1) Personally signed application for residency. 2) Copy of the property title deed (List Nepokretnosti) of not odler than 6 month prior to application. 3) Health insurance policy (covering minimum 30 days from the application date) 4) Proof of funds in the form of bank statement from a montenegrin bank of at least  EUR 3,650 per person per year (EUR 10 per day) 5) Personal passport with at least 1 year validity, copies of all pages 6) Proof that a foreigner has not been legally sentenced to an imprisonment of more than six months in Montenegro or in a country of origin for a criminal offense prosecuted ex officio, or the legal consequences of a conviction ceased; 7) Proof that the application fee (EUR 5+40) for temporary residence is paid

Visa and residence permit in montenegro

Overview of visa regimes for foreign citizens

Mere possession of a visa does not grant the entry to Montenegro. Other legal requirements for granting a foreigner the entry and stay to Montenegro must also be met according to the Law on Foreigners (“Official Gazette of Montenegro”, No. 82/08). Visa regime between Montenegro and other countries is regulated by the Regulation on Visa Regime(“Official Gazette of Montenegro”, No. 18/09). Visa in itself does not offer a grant of permission to work in Montenegro. Person who intends to work in Montenegro must obtain a temporary residence permit for the purpose of employment or seasonal work, on the grounds of previously issued work permit.

Types of Visas

Law on Foreigners (“Official Gazette of Montenegro”, No. 82/08).prescribes the following types of visas:
  • Airport transit ( A)
  • Transit (B)
  • Short stay visa (C)
  • Long stay visa (D)
Airport transit visa (A) may be issued to a foreigner for one or several transits through the airport international transit area, between internationals flights, without entry into the territory of Montenegro, with validity period of up to 3 months. As a general rule, a foreigner who shall not leave the international transit area in between flights at a Montenegro airport or on international flights shall not require a visa. The Government of Montenegro may stipulate that nationals of certain countries, for the national security and legal order reasons, shall require an airport-transit visa. Transit visa (B) may be issued for one, two or exceptionally several transits through the territory of Montenegro, with a validity period of up to 6 months. On the basis of a transit visa, a foreigner may stay in Montenegro for a period of up to 5 days upon each journey. Transit visa may be issued to a foreigner if he/she has secured entry into the state to which he/she is traveling. This visa may be individual and collective. Short stay visa (C) may be issued for one, two or multiple entries into Montenegro for tourist, business, personal or other purposes. Continuous stay or total duration of consecutive stays may not exceed 90 days in the period of 6 months, counting from the date of first entry. Validity period of Visa C for multiple entries is up to one year. Exceptionally this type of visa may be issued for a longer period of validity, but no longer than five year. Short stay visa may be issued to a group of foreigners (collective visa). The validity period of collective visa cannot exceed 30 days and it may be affixed to a group passport. Long stay visa (D) may be issued to an foreigner for one, two or multiple entries into Montenegro, intending to stay in the territory of Montenegro over 90 days, but no longer than 6 months in the period of one year, counting from the date of first entry. This type of visa may be granted to a foreigner:
  • intending to stay in Montenegro in order to perform business or other activities, provide advisory expert activities as agreed by the Agreement on business and technical cooperation, on a long-term production cooperation, and on transfer technologies and foreign investments;
  • coming to serve to Montenegro as a member of foreign diplomatic and consular representative office to Montenegro or an international organizations accredited to Montenegro, member of economic and cultural representative office, as well as to the members of his family, i.e. members of his household holding diplomatic or official passports.
In certain cases, a permission for temporary residence in Montenegro may be considered a long stay visa, which may be, according to Article 35 of the Law on Foreigners, granted to a foreigner intending to stay longer than 90 days in Montenegro, for the purpose of:
  1. employment and work, performing economic or business activity;
  2. seasonal work;
  3. secondary education and studies
  4. participation in student exchange programmes or other youth programmes
  5. specialisation or professional training and acquisition of practical skills;
  6. scientific-research work;
  7. medical treatment;
  8. family reunification;
  9. humanitarian reasons;
  10. other justified reasons specified by law or international agree.

Visa issuance precedure

As a general rule, a foreigner shall submit a visa application personally. In exceptional, justified cases, a foreigner does not have to apply for a visa personally, but does need to appear at the diplomatic or consular representative office once it is issued. For a foreigner who is minor, i.e. legally incapable, visa application shall be filed by a parent or his legal representative.

In addition to the visa application, the foreigner shall submit:

  • valid travel document (the period of validity of the travel document should exceed that of the visa’s by three months);
  • one color photo 35×45 mm;
  • proof of the purpose of stay in Montenegro (letter of guarantee by a physical person or letter of invitation by a legal entity, state authority inMontenegro or organizer of an international conference or event);
  • proof of ensured accommodation (receipt from a tourist arrangement, hotel or other type of accommodation reservation that has been paid in);
  • proof of possession of means for sustenance during his stay in Montenegro, as well as for return into the country where he comes from or for travel into a third state (cash, a bank account, traveler’s checks, credit cards etc.);
  • proof of the means of travel and intention to return into the state where a foreigner comes from or into a third state (a return airplane or other transportation ticket, a driving license);
  • proof of health insurance;
  • proof that the consular fee has been charged,
  • as well as other corresponding documents based on which the purpose and ensured accommodation in Montenegro can be determined

Quali sono i costi fissi che deve sostenere una srl in Montenegro?

Il costo delle società di gestione di contabilità

I costi per la gestione della contabilità societaria partono dai 150 euro/mese. Ogni mese il commercialista presenta la rendicontazione IVA all’Agenzia delle Entrate del Montenegro, il 15 del mese per il mese precedente. Il commercialista elabora inoltre le buste paga e il bilancio, che include lo stato patrimoniale, il conto economico e la nota integrativa.

Quali sono i costi fissi che deve sostenere una srl in Montenegro?

Ogni srl deve avere almeno una posizione contributiva aperta, quindi, almeno un dipendente. Se l’unico dipendente sarà il direttore, questo dovrà attribuirsi almeno lo stipendio netto minimo di 198 euro/mese e versare un importo di 135 euro/mese per tasse e contributi, per un totale di 323 euro mensili (dati aggiornati a Luglio 2018).

Company Liquidation in Montenegro

How can a company be liquidated in Montenegro?

There are two way of liquidate a company, through non judicial procedure or by bankruptcy procedure with the approval from the Bankruptcy tribunal.

"Abbreviated" process of voluntary liquidation of the company

Company Liquidation is a procedure that is carried out when the company has sufficient assets to cover its liabilities.

In a case if the company did not do anything, or had transactions on the account, the best is that the owners run „abbreviated“ process of voluntary liquidation of the company . This is the simplest procedure, when the owner signs a statement that the company has no debts and that will for any debts match the personal assets, for a period of three years.. Also, the „abbreviated“ procedure voluntary liquidation can be initiated in the case when the company operated and the owners are convinced that no outstanding claims. So, the risk is that someone submit a claim within a period of three years, which may be charged from the personal assets of the founder.

You must obtain confirmation from the Tax Administration of Montenegro that the tax has been paid.

 

Start bankruptcy proceedings

Corporate Bankruptcy is a procedure that can be carried out as a bankruptcy or reorganization of the debtor (entrepreneur or legal entity) that is unable to pay debts owed.

In a case, if the company had a turnover through the account and there are no funds to pay debts to creditors, can to start bankruptcy proceedings . The court orders the Trustee, notices debtors (and the IRS), and after verifying that the company has no assets from which the creditors can not collect debts, finish bankruptcy and liquidate the company.

The procedure is conducted at the Commercial Court of Montenegro.

In the process of bankruptcy and liquidation of the company,the owner of the company does not respondwith his property for the debts of society.

How long does it take to liquidate a company in Montenegro?

It takes 7 days for a „shortened“ liquidation of the company.

It takes 60 days for liquidation of the company through „bankruptcy“.

In more complex cases it takes 1.2 years, if the claims are challenged or other issues arise.

Liquidation costs

The costs of the „shortened“ liquidation process amount to a total of 350E.

Liquidation costs through bankruptcy are 1,050EUR.

The fee to the Commercial Court is 560 Euros. Our service is 500E.

The application for a residence permit in Montenegro has to contain the following documents:

If you buy a real estate …

This temporary residence permit can be extended annually and can be obtained only by the following categories of owners: of houses, apartments, Montenegrin companies, hotels, restaurants and holiday homes, regardless of the value of the property or business.

In case of granting a residence permit to a foreigner for seasonal employment, proof of secured means of subsistence, provided accommodation and provided health insurance is considered confirmation of a company or entrepreneur in which a foreigner intends to work.

Upon request for temporary stay, the Ministry of Internal Affairs shall decide within 20 days of the filing of a proper application.

 

According to the request for a residence permit for seasonal employment, the Ministry of Internal Affairs shall decide within seven days of filing of a proper application.

 

The residence permit of a foreigner to find employment and work, performing economic or entrepreneurial activity shall be issued for a period specified in the work permit. The residence permit of a foreigner for seasonal employment may be granted for a period of up to eight months in a calendar year.

Family reunification

A residence permit may get those who: Is registered as an individual entrepreneur or opens his own company in Montenegro (with registration of a legal entity). In this case a permanent residence is immediately available to the applicant and his family can join him.

Permanent place of residence in Montenegro

Naturalization procedure:

– Has reached 18 years of age;

– Has a release from foreign citizenship;

– Has been legally and without interruption staying in Montenegro for the period of 10 years, prior to the petition for admission into Montenegrin citizenship;

– Has a guaranteed residence and guaranteed permanent source of income in Montenegro of an amount that enables material and social welfare; – Has not been irrevocably sentenced in Montenegro  or a foreign state to a prison term longer than one year and for a criminal offence prosecuted “ex officio” or legal consequences of such sentence are ceased;

– Possess active command of the Montenegrin language to the level which allows basic communication;

– Poses no threat to the security and defense of Montenegro;

– Discharged his/her tax obligations.

Procedure imply that foreigner must prove Montenegrin language proficiency as well as have 10 years of legal residence in Montenegro. Moreover, the applicant must renounce his previous citizenship to felicitate oneself with Montenegrin passport. 

Over 18 years of age may exceptionally obtain Montenegrin citizenship through naturalization if this is to the benefit of the state for scientific, economic, cultural, economic, sports national or similar reasons. On admission into Montenegrin citizenship under paragraph 1 of this Article, shall decide the Government on proposal of the competent State Administration Authority, with the opinion of the State Administration Authority competent for the affairs of citizenship.

 

Birth on the territory of Montenegro does not automatically lead to citizenship.

Economic passport in other countries:

 

The expenses for Bulgaria, if you choose a full investment option, will be around 1,024,000 EUR (512,000 EUR must be invested into government bonds to get permanent residency and another 512,000 EUR must be invested in Bulgarian business after 1 year to fast track citizenship application). Under loan option (donation or contribution) you irrevocably invest 305,000 EUR and get Bulgarian (EU) citizenship. Dominica is not really good because its passport is not visa free for Europe (with exception of the UK). Saint-Kitts is a good option especially for those clients who will be OK with visa-free access to EU-country. But if you wish to settle permanently in Europe in the future the only fast citizenship option (which is relatively cheap in comparison with Austria or Cyprus) is Bulgaria. Cyprus will require at least 2,000,000 EUR for an applicant to become eligible for fast track citizenship application; Austria will require 10,000,000 EUR.
